This coming weekend I will be attending the 54th College Music Society National Conference in Richmond, VA. On Saturday morning I will be presenting a lighting talk (a 5-minute brief exploration/introduction to a specific problem or idea). The abstract for my lightning talk is below. Permission Granted: Navigating Copyright Minefields on a Shoestring
When budgets are thin it is always tempting to cut copyright corners. Some of the more common copyright infringements include duplicating instrumental parts, photocopying scores, and ripping audio CDs. In an educational setting it becomes even more tempting because teachers and instructors can hide behind the curtain of "Fair Use." Fair use, however, is so vague and nebulous that it rarely gets upheld in court. As a result, many teachers get stuck between paying the full price for multiple copies of materials and making illegal copies. Some feel that copyright law in the U.S. is in a bad place by continually restricting the public‘s access to our culture‘s goods and ideas. Thankfully, a third way exists. Creative Commons creates licenses that bridge the gap between complete copyright control and the public domain, allowing people to use new and copyrighted material in a variety of ways, often for free, and there is a growing culture of innovators, creators, and educators releasing new material for public use under Creative Commons licenses. It is imperative that composers, performers, and music educators of the 21st Century understand the state of current copyright law and the legal options that are available to them.
